> **IMPORTANT:** OpenClaw is powerful automation software and can be risky. This Product is provided with best-effort baseline hardening, but no system is perfectly secure.
> This Product is **not affiliated with or endorsed by** Amazon Web Services (AWS), Amazon, or OpenClaw.
> By purchasing or using the Product, you acknowledge and accept these risks.
## 1. Agreement to Terms
These Terms and Conditions ("Terms") govern your purchase and use of **OpenClaw EasyStart for AWS** (the "Product") and any related materials we provide with it. If you do not agree, do not purchase or use the Product.
## 2. Product identity and branding

## 3. Definitions
- **Customer**: the individual or entity purchasing the Product.
- **EasyStart**: access to an AWS Amazon Machine Image (AMI) plus written instructions for launching and configuring OpenClaw with Telegram and a supported AI inference provider.
- **OpenClaw**: the open-source software known as OpenClaw and any community or third-party skills, plugins, or integrations.
- **AWS**: Amazon Web Services, including Amazon Elastic Compute Cloud (EC2), Amazon Machine Images (AMIs), Identity and Access Management (IAM), and related services.
- **Third-party Services**: any services, platforms, APIs, or vendors you use with the Product, including AWS, Telegram, AI inference providers, GitHub or open-source dependencies, payment processing providers, and any systems you connect or that receive data from the Product.
- **AI Agent**: any autonomous or semi-autonomous tool, agent, or model you use that can modify configuration, execute actions, or install software/skills.
## 4. Deliverables and acceptance
The deliverables for **EasyStart** are:
(a) access to the AWS AMI image for the Product for a 2-week access window from purchase date, and
(b) written instructions for launching and configuring it.
You may copy the AMI into your own AWS account during that 2-week access window. After the window ends, access sharing may be removed, but your copied AMI in your account remains yours to use subject to these Terms and AWS policies.
**Acceptance** occurs upon your receipt of the AMI access and the instructions.
**Not included:** Any work beyond the deliverables above is not included, including customization, installation of additional skills or software, tuning, upgrades to newer OpenClaw versions, operating system updates, ongoing maintenance, monitoring, backups, security audits, incident response, compliance work, Telegram app/account setup on your devices, or AI provider plan/account setup and administration.
**No ongoing support:** Unless you purchase a separate written support agreement, we do not provide support after acceptance.
## 5. Customer responsibilities
You are solely responsible for:
- Your AWS account and environment, including Identity and Access Management (IAM) users/roles, multi-factor authentication (MFA), networking, Security Groups/firewalls, logging, encryption settings, backups, and cost controls.
- All keys, application programming interface (API) credentials, tokens, and secrets (including Telegram tokens and AI inference provider API keys).
- All AI inference plan, subscription, usage, and token costs from your chosen provider, and all setup/configuration/maintenance of your AI provider account.
- Reviewing, understanding, and complying with the terms of all Third-party Services you use, including AWS, Telegram, your AI inference provider, and Stripe.
- Installation of Telegram on your own device(s), and setup/maintenance of your Telegram account.
- Installation, configuration, and security vetting of any OpenClaw skills/plugins (whether installed by you or via the bot/AI Agent).
- All actions taken by OpenClaw, any skills/plugins you install, any AI Agents you use, and any outputs generated.
**Do not email secrets to us.** If you choose to share secrets during a live session, you do so at your own risk.
## 6. Risk acknowledgment and release
You acknowledge that OpenClaw and automation systems can execute actions, send data to Third-party Services, and may behave unexpectedly due to configuration, skills, prompts, integrations, model behavior, software defects, or misuse. You further acknowledge that using Third-party Services (including AWS, Telegram, and AI inference providers) introduces additional security, privacy, and availability risks.
You acknowledge that heavy or continuous OpenClaw usage can generate significant AI token consumption, rate-limit events, and substantial third-party charges. You are solely responsible for monitoring and controlling usage, budgets, and billing alerts with your AI provider and AWS.
To the maximum extent permitted by law:
- You accept all risks associated with your use of the Product, OpenClaw, any installed skills, and all Third-party Services.
- You release PerksMinder and its officers, members, managers, employees, contractors, and agents from claims arising from or related to:
(a) actions taken by OpenClaw or any skills/plugins,
(b) data leakage, disclosure, loss, corruption, or transmission to or through Third-party Services,
(c) model outputs or decisions,
(d) unauthorized access, or
(e) outages or changes in Third-party Services.
- This release does not apply to the extent prohibited by applicable law.
## 7. Changes, skills, and modifications
The Product is delivered with a baseline configuration. Any modification after acceptance can materially change risk and security posture.
- If you or your personnel modify the installation, system settings, firewall rules, exposed ports, user accounts, or secrets management, you assume all resulting risk and responsibility.
- If you or an AI Agent installs or enables any skills/plugins, additional software, or integrations, you assume all resulting risk and responsibility, including security regressions and data exposure.
- OpenClaw may integrate with multiple communication providers (for example Telegram, Slack, Discord, or WhatsApp), but EasyStart setup instructions and install warranty are provided for Telegram configuration only.
- You are solely responsible for installing Telegram on your devices and creating/managing your Telegram account.
## 8. Open-source and third-party licensing
The Product includes third-party and open-source software (including OpenClaw and Ubuntu packages) that is licensed to you by its respective licensors under their license terms. OpenClaw is provided under the MIT License. Ubuntu and installed packages include many components under their own licenses.
- You agree to comply with all applicable third-party licenses and terms.
- We provide a Third-Party Notices file with the Product describing key third-party licensing and where to find additional license texts on the instance (for example under `/usr/share/doc/*/copyright`).
- Your use of AWS is governed by AWS agreements and policies (including the AWS Customer Agreement and AWS Service Terms). You are solely responsible for AWS configuration and all AWS fees and charges.
## 9. Acceptable use and prohibited uses
You agree not to use the Product, OpenClaw, any skills/plugins, or any related materials to engage in prohibited activities, including:
- Gain unauthorized access to systems, accounts, networks, or data, including activity that violates the Computer Fraud and Abuse Act (CFAA) or similar laws.
- Collect, harvest, scrape, or exfiltrate credentials, API keys, session tokens, personal data, or proprietary information without explicit permission.
- Perform phishing, social engineering, impersonation, or deception intended to obtain access, money, data, or credentials.
- Create, distribute, or deploy malware, spyware, ransomware, keyloggers, botnets, exploits, or instructions intended for wrongdoing.
- Intercept, monitor, or record communications without lawful authority and required consent (including unauthorized packet capture or wiretapping).
- Run vulnerability scanning, penetration testing, or red-team activity against any third-party systems without written authorization from the system owner.
- Engage in denial-of-service (DoS) or distributed denial-of-service (DDoS) attacks, traffic flooding, or actions designed to degrade service availability.
- Circumvent security controls, rate limits, paywalls, access controls, or licensing restrictions of any Third-party Services.
- Use the Product in a way that violates the terms, policies, or acceptable use rules of AWS, Telegram, your AI inference provider, or any other Third-party Services you connect.
- Process, store, or transmit regulated or high-risk data unless you have implemented appropriate safeguards and legal authority, including protected health information (PHI) subject to the Health Insurance Portability and Accountability Act (HIPAA) or payment card data subject to the Payment Card Industry Data Security Standard (PCI DSS).
- Use the Product for illegal content, harassment, threats, hate, or other unlawful conduct.
- Use the Product in hazardous or life-critical environments (medical, emergency response, critical infrastructure) where failure could lead to harm.
Installing third-party or community OpenClaw skills can create security, privacy, and reliability risks. You are solely responsible for evaluating, testing, and approving any skills before use.
If we reasonably believe you have violated this section, we may refuse service and terminate access to Product materials without refund to the maximum extent permitted by law.
## 10. Data handling and privacy
We handle only customer contact information and any support emails you send to us. If you send logs or configuration excerpts, you are responsible for redacting sensitive data. Our Privacy Policy describes our handling of personal information.
## 11. Fees, payment processing, billing descriptor, taxes, and refunds
Fees are due at purchase. You are responsible for all taxes, duties, and charges imposed by any government authority.
**Payment processor:** Payments are billed through **Stripe**. Stripe collects and processes your payment information. **PerksMinder does not have access to or retain customer payment information** (such as full card numbers) for purchases.
**Billing descriptor:** Your statement may reference Stripe. Billings may also appear with the descriptor **PerksMinderLLC**.
Because the Product includes access to digital materials and/or cloud resources, refunds are not available after acceptance, except where required by law or as expressly stated in writing by PerksMinder.
## 12. Intellectual property and license
We grant you a limited, non-exclusive, non-transferable license to use PerksMinder-provided documentation and materials for your internal use with the Product. You may not resell, redistribute, or publicly post our documentation or materials without written permission. OpenClaw and other third-party components are governed by their own licenses.
## 13. Disclaimers
The Product is provided **as-is** and **as available**. To the maximum extent permitted by law, PerksMinder disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Product will be secure, error-free, or uninterrupted.
## 14. Limitation of liability
To the maximum extent permitted by law:
- PerksMinder will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, business interruption, or goodwill.
- PerksMinder’s total aggregate liability arising out of or related to the Product will not exceed the total amount you paid to PerksMinder for the Product giving rise to the claim.
## 15. Indemnification

## 16. Dispute resolution and arbitration
Any dispute, claim, or controversy arising out of or relating to these Terms or the Product will be resolved by **binding arbitration** on an individual basis and not in a class, consolidated, or representative action. The arbitration will take place in Minnesota unless the parties agree otherwise. Judgment on the award may be entered in any court of competent jurisdiction.
Nothing in this section prevents either party from seeking injunctive relief to protect intellectual property or confidential information.
## 17. Governing law
These Terms are governed by the laws of the State of Minnesota, without regard to conflict of laws principles.
## 18. High-risk use
The Product is not designed, intended, or warranted for use in hazardous or high-risk activities where failure could lead to death, personal injury, or severe physical or environmental damage (for example, emergency response, medical diagnosis or treatment, or critical infrastructure control).
## 19. Miscellaneous

- **Severability:** If any provision is found unenforceable, the remaining provisions remain in effect.
